0. Definition of Terms

Website Administration – Administration of www.eco-taxi.ge, which manages the Website and constitutes the owner.

User – a person who visits the site, aims to receive the services provided by the website and/or its separate components and to use it as intended.

Data – any information directly or indirectly related to an identified or identifiable natural or legal person.

1.Preamble

The present terms and conditions describe the rules and features of using the website, constitutes an agreement between you and us, which is considered as agreed between the parties upon using the website and/or using our services.

If you do not fully agree with these Terms and Conditions, please do not use the Website.

In order to improve and improve the quality of service, the administration of the website reserves the right, without notifying you, to change the present rules. All changes take effect immediately and are reflected on the website. The user is obliged to periodically check the rules of use of the website. Using the website automatically means the user’s consent to the changed terms.

2. Provision and Scope.

Within the using the website and/or its component, you confirm that you fully aware with the rules, data policy and related information.

The terms and conditions apply equally to the user, regardless of the devices he uses.

3. Website and its purpose.

The website promotes eco-activities and related educational issues, raises awareness, and etc., which is aimed to public audiences.

The registration or creating the account is not necessary for using the Website.

4. Final Provisions

The Terms and conditions are drawn up and governed by the laws of Georgia, and will be interpreted accordingly, regardless of your location and origin.

The material, content, description, business description, texts, data, images, illustrations and all information provided on the website and related to the company’s brand are protected by intellectual property and copyright. It is not allowed to use them for any purpose other than the purposes of the website.

What I Recycle — Privacy policy & Terms of use

Summary

Eco Sakartvelo LLC (“we”, “us”) offers What I Recycle to help users sort household waste in line with Eco-taxi guidelines. The product includes a mobile application and a web scanner.

When you use cloud classification, your photo is transmitted so that Google’s cloud AI (Gemini) can process it under Google’s applicable Gemini API and Google Cloud terms. How Google handles requests on its infrastructure is governed by those documents. We do not use simplified legal labels (such as “processor”) for Google’s role here; the legal characterisation depends on the product configuration, agreements, and applicable law.

Photos on our side: We do not store photos in our application databases or file storage after the classification request completes. We do not use your photos for marketing, sale to third parties, or secondary processing beyond returning that classification result.

What we retain: Account-related and operational data needed to run the service (for example sign-in identifiers on the web, scan counts, and optional device-linking identifiers for shared paid scan balance), as described below.

1. Who operates the service

Operator: Eco Sakartvelo LLC, operating What I Recycle for the Eco-taxi programme.

Apple App Store: The iOS app is published by Eco Sakartvelo LLC.

Google Play: The Android app may be published by an authorised Google Play publisher acting under licence from Eco Sakartvelo LLC, where required for Google Play merchant and distribution rules. Eco Sakartvelo LLC remains responsible for describing how the What I Recycle service handles personal data in this policy.

2. Data we process

2.1 Photos (cloud classification)

When you request cloud AI classification, your image is sent (including via our servers where applicable) so that Google’s Gemini can return a suggestion. We do not retain your image in our databases or file storage after that request completes.

2.2 Account and usage data (web)

If you use the web scanner with Google sign-in, we process identifiers and profile elements provided by Google (such as Google account ID, email, name, profile picture URL) only to authenticate you, enforce free scan limits, and operate linked paid balances.

2.3 Purchases

Apple and Google process in-app purchases and related payment metadata (for example transaction IDs, receipts, consumable or subscription state, refunds, fraud signals) under their own terms. We do not receive full payment card numbers. We may receive purchase-related records needed to credit scan packs and to meet accounting or legal obligations.

2.4 Device linking (optional)

If you link a mobile device to a web account, we may store a device identifier (or equivalent) needed to apply purchased scan balance across platforms.

2.5 Local-only mode (if offered)

If a local-only mode is offered, it will be labelled separately from cloud AI classification so users can understand whether their image is processed locally or sent for cloud AI classification.

3. Legal bases for processing

Where applicable data protection law requires a legal basis, we process personal data on the following grounds:

  • Providing the service. We process photos submitted for cloud classification, account identifiers, scan limits, and device-linking information where necessary to provide the What I Recycle scanner, return sorting suggestions, manage access, and apply free or purchased scan balances.
  • Legitimate interests. We may process limited operational metadata and short-lived technical logs where necessary to keep the service secure, prevent abuse, enforce usage limits, debug errors, and maintain reliability, where those interests are not overridden by your rights and freedoms.
  • Legal obligations. Where required, we may retain limited records related to purchases, refunds, accounting, tax, compliance, or lawful requests.

Consent: We do not rely on consent for ordinary cloud photo classification, because submitting an image is necessary to obtain the classification result. If we introduce optional processing that is not necessary for the service, such as marketing, non-essential analytics, or model-training use of user images, we will identify the appropriate legal basis and request consent where required.

4. Google and third parties

Image analysis uses Google’s cloud AI under Google’s applicable terms. We do not sell personal data. We do not share photos with unrelated third parties for their own independent purposes.

App-store privacy questionnaires use their own definitions; answers there should stay consistent with this policy.

5. Your rights

Subject to applicable law, you may have rights including: access, rectification, erasure, restriction, objection, data portability, and the right to withdraw consent where processing is based on consent. You may also have the right to lodge a complaint with a supervisory authority.

6. Age and cloud classification

Because cloud AI classification in What I Recycle relies on the Google Gemini API, the cloud classification feature is not intended for users under 18. Users under 18 should not use cloud AI classification. If a local-only mode is offered, it will be labelled separately and may be subject to different age rules.

7. Location of processing

Cloud infrastructure used to provide the service (including Google’s services and our hosting) may be located outside Georgia. Google’s processing is subject to Google’s terms and policies.

8. Changes to this policy

We may update this policy to reflect product or legal changes. We will notify users where required by law. The “Last updated” date at the top of this page will change when we do.

Part B — Terms of use

1. Service

What I Recycle helps you obtain informational sorting suggestions for household waste in line with Eco-taxi guidelines. Suggestions are based on what you submit (such as a photograph). Always follow current Eco-taxi sorting information on eco-taxi.ge and any applicable local rules.

Cloud classification and age: Cloud AI classification is not intended for users under 18; see Part A, Section 6 and the applicable Google Gemini API terms.

2. Acceptable use

You agree not to misuse the service (including attempting to overload systems, probing for vulnerabilities, or submitting unlawful content). We may suspend access if abuse is detected.

3. Accounts, scans, and purchases

  • The web scanner may require sign-in and applies a limited number of free scans per period.
  • Additional scans may be purchased via in-app purchases on mobile; optional device linking may allow use of purchased balance on the web.
  • Fees and refunds follow Apple’s or Google’s store rules. Apple and Google process purchase-related metadata as described in Section 2.3 of the Privacy policy.

4. Privacy

Personal data is processed as described in Part A of this document.

5. Disclaimers

What I Recycle provides automated, informational sorting suggestions based on the information submitted by the user. Suggestions may be inaccurate or incomplete, and users should follow current Eco-taxi sorting guidelines and applicable local rules.

The service is provided “as is” to the maximum extent permitted by law. To the maximum extent permitted by law, we are not liable for losses arising solely from a user’s reliance on an automated sorting suggestion.

Nothing in these Terms limits or excludes any consumer rights or other rights that cannot be limited or excluded under applicable law.

6. Intellectual property

Eco-taxi and What I Recycle branding, content, and software are protected. Do not copy or redistribute except as allowed by law or with permission.

7. Governing law

These terms are governed by the laws of Georgia, unless mandatory consumer laws in your country provide otherwise.

8. Changes to these terms

We may update these terms; the “Last updated” date will change. We will provide notice where required by law.
